Times-Standard, PUBLIC NOTICE HUMBOLDT COUNTY PLANNING COMMISSION NOTICE OF PUBLIC HEARING AND INTENT TO ADOPT A MITIGATED NEGATIVE DECLARATION On Thursday, August 6, 2015 at 6:00 p.m., or as soon thereafter as the matter can be heard, the Humboldt County Planning Commission will hold a public hearing in the Board of Supervisors' Chamber, Humboldt County Courthouse, 825 Fifth Street, Eureka, California, to consider the matter listed below. It is being recommended that the Planning Commission adopt a Mitigated Negative Declaration (finding of no significant adverse environmental effect). Wojcik Reclamation (Restoration) Plan; Application Number 9602; Case Number RP-15-001; Assessor Parcel Numbers 210-031-002; 210-033-003; 210-032-003; 210-033-005; 210-250-028. The project is a Reclamation Plan proposed as a result of a Surface Mining and Reclamation Act (SMARA) violation where unpermitted mining activities took place within a peatland called the "Van Duzen Fen." Unpermitted mining activities consisted of extraction of peat from within the Fen, water diversion, unpermitted grading, and other activities. The Reclamation Plan is proposed for the sole purpose of restoring natural biological and hydrologic conditions and processes to the Van Duzen Fen and nearby areas similarly disturbed by past mining activities. No further mining is proposed with implementation of the Reclamation Plan. The project is located in portions of sections 1, 2, 11, 12, and 13 within T1N R4E HBM. The Van Duzen Fen and Wotherspoon Flat are located on Humboldt County APN 210-031-002 and the Processing Area pond is located on APN 210-033-003. The Residence Pond lies on APN 210-032-003 and Carter Flat lies on parcels APN 210-033-005 and APN 210-250-028. The Humboldt County Planning Commission intends to adopt a Mitigated Negative Declaration of Environmental Impact for this project. Any person may appear and present testimony in regard to this matter at the hearing. If you challenge the nature of the proposed action in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the Planning Commission at, or prior to, the public hearing. The Planning Commission needs ONE ORIGINAL AND 14 COPIES of any materials submitted either prior to or at the meeting. The Planning Commission's decision will become effective if an appeal is not filed within the appropriate filing period. An appeal may be filed by any aggrieved person who has testified in person or in writing on the project and must be submitted in writing with the required fees to the Planning Division of the Humboldt County Planning and Building Department before the end of the appeal period. If appealed, the decision will not become effective until the appeal is resolved.
