The Oneida Daily Dispatch, LEGAL NOTICE (Amended) RESOLUTION #1 2015 Resolution to Establish a General Highway Capital Reserve Fund BE IT ENACTED, by the Town of Lenox Board as Follows: WHEREAS, it is the sense of the Town of Lenox Board That it would be for the best interest of the Town of Lenox to Establish a General Highway Capital Reserve Fund for the payment or repairs of all or part of unspecified highway equipment; and WHEREAS, under General Municipal Law Section 6-c(5)(b) the State of New York permits a Municipal Corporation, by simple resolution, to establish such a reserve fun. NOW THEREFORE BE IT RESOLVED, BY THE TOWN BOARD OF LENOX RESOLVED AND DETERMINED, pursuant to General Municipal Law Section Section 6-c(5)(b) the Town of Lenox shall establish a General Highway Capital Reserve Fund to cover the payment or repairs of all or part of unspecified highway equipment, and BE IT FURTHER RESOLVED that the Town Supervisor’s Secretary is authorized and directed to establish and maintain a separate savings account in accordance with the laws and regulations of New York State, and BE IT FURTHER RESOLVED, that this Resolution is subject to a permissive referendum, pursuant to General Municipal Law §6-c, and shall not be effective unless either no petition requesting a referendum meeting the requirements of Town Law §91 is filed on or before August 12, 2015, or this Resolution is approved by the affirmative vote of majority of the qualified electors of the Town of Lenox voting on approval of the Resolution; and BE IT FURTHER RESOLVED the this Resolution is subject to the approval of the Town of Lenox Superintendent of Highways and the approval of the Madison County Superintendant of Highways, (GML Section 6-c(5)(b)); and BE IT FURTHER RESOLVED that expenditure of the Reserve Fund herein shall be on order of the Town of Lenox Superintendent of Highways upon audit and with the consent of the Town of Lenox Board, (GML Section 6-c(5)(b)); and BE IT FURTHER RESOLVED that a resolution authorizing any expenditure there from would be subject to a permissive referendum (GML Section 6-c); and BE IT FURTHER RESOLVED, that the Town Clerk shall publish a notice in the Oneida Daily Dispatch the official Town newspaper the following: (1) set forth the date of the adoption of this Resolution; (2) contain an abstract of this Resolution concisely stating its purpose and effect; (3) specify this Resolution was adopted subject to a permissive referendum; (4) state that on or before August 12, 2015, a petition signed, and acknowledged or proved, or authenticated by electors of the town qualified to vote upon a proposition to raise and expend money, in number equal to at least five per centum of the total vote cast for governor in the Town in 2010, but which shall not be less than 25, protesting against the Resolution and requesting that it be submitted to the qualified electors of the Town for their approval or disapproval; and BE IT FURTHER RESOLVED, the Town Clerk shall also cause a copy of the Notice to be posted on the sign board of the Town maintained pursuant to Town Law §30(6), and posted on the Town website, on or before July 14, 2015.
