Berkshires Marketplace, NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain mortgage given by Edlyne Jean-Louis to Mortgage Electronic Registration Systems, Inc., dated September 20, 2006 and recorded with the Berkshire County (Middle District) Registry of Deeds at Book 3626, Page 223, of which mortgage the undersigned is the present holder by assignment from Mortgage Electronic Registration Systems, Inc. to The Bank of New York Mellon as Trustee for the Certificateholders CWABS, Inc., Asset-Backed Certificates, Series 2006-18 dated March 17, 2010 and recorded with said Registry on March 25, 2010 at Book 4507, Page 260 and by a corrective assignment from Mortgage Electronic Registration Systems, Inc. to The Bank of New York Mellon fka The Bank of New York, as Trustee for The Certificateholders of the CWABS, Inc., Asset-Backed Certificates, Series 2006-18 c/o Specialized Loan Servicing LLC dated September 12, 2013 and recorded with said Registry on September 13, 2013 at Book 5265, Page 129, for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at 10:00 a.m. on July 8, 2015, on the mortgaged premises located at 15 Merriam Street, Pittsfield, Berkshire County, Massachusetts, all and singular the premises described in said mortgage, TO WIT: Being Lot numbered forty (40) on a plan of building lots as laid out and surveyed by Theodore W. Hill, Civil Engineer, for Barker & Foote, which said plan is recorded in the Berkshire Middle District Registry of Deeds in Drawer I. Said lot is sixty-six (66) feet wide on Merriam Street and one hundred twenty (120) feet deep, and is bounded northerly by Lots thirty-nine and thirty-eight owned now or formerly by one Feeley, easterly by Lot thirty-six, southerly by Lot forty-one, and westerly by said Merriam Street. Subject to the restrictions contained in the deed of Charles L. Barker et al. to Fred C. Rice et al. dated September 13, 1902 and recorded in said Registry of Deeds in Book 315, Page 622. Subject to any and all easements and encumbrances of record. Being all and the same premises conveyed to the mortgagor herein by deed of Susan A. Dea dated September 20, 2006 and recorded in the Berkshire Middle District Registry of Deeds on September 21 , 2006 in Book 3626 Page 221. For mortgagor's(s') title see deed recorded with Berkshire County (Middle District) Registry of Deeds in Book 3626, Page 221. These premises will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed. TERMS OF SALE: A deposit of Five Thousand ($5,000.00) Dollars by certified or bank check will be required to be paid by the purchaser at the time and place of sale.
