Las Cruces Sun News, NOTICE is hereby given that on July 16, 2015, Growers Pecans, LLC, PO Box 370, Mesquite, NM 88048 & WestStar Bank, 500 N Mesa, El Paso, TX 79901, filed application numbered LRG-04197-POD11, associated with File No's: LRG-04197 & LRG-04197-B, with the State Engineer for Permit to Change Location of Well within the Lower Rio Grande Underground Water Basin in Doña Ana County by discontinuing the use of well LRG-04197-S, located on land owned by the applicant within the SE1/4 NW1/4 of Projected Sec. 12, T25S, R2E, NMPM, and more specifically described at X=1,503,680 ft. & Y=418,771 ft. (NMSP, Central NAD83), and drilling replacement well LRG-04197-POD11 with a 16" casing approximately 300' in depth, to be located at approximately X=1,503,732 ft. & Y=418,767 ft. (NMSP, Central NAD83), on land owned by the applicant for the continued diversion of an amount of shallow underground water determined by the May 24, 1999 Order of the Third Judicial District Court, Doña Ana, NM, combined with surface water from EBID for the irrigation of 524.88 acres of land owned by the applicant located within said Projected Sec.12, as described by Subfile No.: LRS-28-007-0075 of the Lower Rio Grande Basin Hydrographic Survey. The applicant has requested emergency authorization to drill the proposed well under NMSA, 1978, Section 72-12-22. Well LRG-04197-POD11 can be found South of Las Cruces at the physical address of Highway 478, approximately 0.23 miles west of Highway 478. Existing well LRG-04197-S is to be properly plugged. Any person, firm or corporation or other entity having standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer's complete name, phone number and mailing address). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you must show how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, 1680 Hickory Loop, Suite J, Las Cruces, NM 88005-6598 within ten (10) days after the date of the last publication of this Notice. Facsimiles (faxes) will be accepted as a valid protest as long as the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, (575) 524-6160.
