Times-Standard, PUBLIC NOTICE HUMBOLDT COUNTY ZONING ADMINISTRATOR NOTICE OF PUBLIC HEARING AND INTENT TO ADOPT A MITIGATED NEGATIVE DECLARATION On Thursday, September 17, 2015 at 10:00 a.m. or as soon thereafter as the matter can be heard, the Humboldt County Zoning Administrator will hold public hearings in the upstairs conference room (Conference Room 204) of Humboldt County Planning and Building Department, at 3015 H Street, Eureka, California, to consider the matter listed below. It is being recommended that the Zoning Administrator adopt a Mitigated Negative Declaration (finding of no significant adverse environmental effect). Specific questions regarding the proposed project and the draft Mitigated Negative Declaration may be directed to Emily Benvie, Planner, at (707) 445-7541. JAMES JOHNSTONE, Trinidad Area; Application Number 9572; Ca No. CDP-04-032M/SP-04-040M (filed 12/19/2014); APN 517-231-074. A Coastal Development Permit and Special Permit for construction of a single family residence. The scope of development includes a 2-story 2,198 square-foot single family residence that will have a maximum height of 25-27 feet, a 708 square-foot garage and storage area, 408 square feet of decking, an on-site wastewater treatment system, a paved driveway, and four- to six- foot retaining walls to accommodate the driveway. The parcel will be served by water from Seawood Estates Mutual Water Company. A Special Permit is required for Design Review, removal of three trees, a parking exception due to topographical constraints, and a reduction to a 50-foot setback from an ephemeral stream. A Biological Report was prepared in 2004 for the original project, and an addendum was prepared in January 20, 2015, to ensure the conditions have remained the same. The proposed residence will not decrease the setbacks any greater than the original biological report contemplated. The project is located in Humboldt County, in the Trinidad Area, on the east side of Westgate Drive, approximately 465 feet east from the intersection of Patricks Point Drive and Westgate Drive, on the property known as 108 Westgate Drive. The Humboldt County Zoning Administrator intends to adopt a Mitigated Negative Declaration of Environmental Impact for this project. Any person may appear and present testimony in regard to this matter at the hearing. If you challenge the nature of the proposed action in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the Zoning Administrator at or prior to the public hearing. The Zoning Administrator needs ONE ORIGINAL AND 4 COPIES of any materials submitted either prior to or at the meeting. The Zoning Administrator's decision will become effective if an appeal is not filed within the appropriate filing period. An appeal may be filed by any aggrieved person who has testified in person or in writing on the project and must be submitted in writing with the required fees to the Planning Division of the Humboldt County Planning and Building Department before the end of the appeal period. If appealed the decision will not become effective until the appeal is resolved. Appeals may be filed in the Planning Division of the Humboldt County Planning and Building Department, Monday through Fridays between the hours of 8:30 am and 5:00 pm. The staff report for this project will be available on the County web site http://www.humboldtgov.org/196/Zoning-Administrator on the Friday before the Zoning Administrator meeting. At any time prior to opening the public hearing on this application, the Zoning Administer is authorized by the County Code to pull and refer the application to the Humboldt County Planning Commission for hearing and decision. If this project is referred for hearing to the Planning Commission, the County will provide public notice of the new hearing in accordance with provisions of State law.
