Times Union, NEW YORK STATE DEPARTMENT OF TRANSPORTATION OFFICE OF RIGHT OF WAY NOTICE OF APPROPRIATION OF PROPERTY IN THE BED OR BEDS OF A STREAM, LAKE, STREET, ROAD, HIGHWAY, OR RIGHT OF WAY PROJECT: SH 41-1 MOHAWK GOLF CLUB-AQUEDUCT, PART 2 COUNTY: SCHENECTADY MAP NO. 29 PARCEL NO. 36 TAKE NOTICE THAT PURSUANT TO EMINENT DOMAIN PROCEDURE LAW NOTICE is hereby given that there were filed in the office of the Department of Transportation on the 28th day of August, 2014, description and original tracing of a map together with a certificate as to the accuracy thereof, of property which the Commissioner of Transportation deemed necessary to be acquired immediately for purposes connected with the project identified above that; there was filed in the office of the SCHENECTADY County Clerk on the 5th day of November 2014, a copy of such description and map, whereupon the appropriation by the State of the property described in such description and map became complete and the title to such property vested in the People of the State of New York. Description and map of property which the Commissioner of Transportation deems necessary to be acquired by appropriation in the name of the People of the State of New York for purposes connected with the highway system of the State of New York pursuant to Section 30 of the Highway Law and the Eminent Domain Procedure Law. There is excepted from this appropriation all the right, title and interest, if any, of the United States of America, in or to said property. That the following is a description of such property, to wit: All that piece or parcel of property designated as Parcel No. 36, as shown on the accompany map, to be acquired in Fee and described as follows: Parcel No. 36 Beginning at a point in the easterly boundary of Mohawk Golf Club-Aqueduct Pt. 2, S.H. 41-1, as acquired in 1964, by map 13 parcel 18, said point being 110+/- feet distant southeasterly, measured at right angles, from station 52+58+/- of the hereinafter described survey baseline for the reconstruction of a portion of Mohawk Golf Club-Aqueduct Pt. 2, S.H. 41-1; thence easterly 44+/- feet to the point in the northerly boundary of East Street, an existing town highway, being 150+/- feet distant southeasterly, measured at right angles, from station 52+75+/- of said baseline; thence along the easterly boundary of a portion of the road bed of River Street the following seven, (7) courses and distances: (1) northwesterly along a curve to the right having a radius of 25.0 feet and an arc distance of 41.0 feet to a point 117+/- feet distant southeasterly, measured at right angles, from station 52+90+/-of said baseline: (2) northerly 51+/- feet to a point 100+/- feet distant southeasterly, measured at right angles, from station 53+38+/- of said baseline; (3) northeasterly along a curve to the right having a radius of 65.0 feet and an arc distance of 58.1 feet to a point 105+/- feet distant southeasterly, measured at right angles, from station 53+93+/- of said baseline; (4) easterly 39+/- feet to a point 125+/- feet distant southeasterly, measured at right angles, from station 54+27+/- of said baseline; (5) northeasterly along a curve to the left having a radius of 268.0 feet and an arc distance of 122.04 feet to a point 147+/- distant southeasterly, measured at right angles, from back tangent produced ahead, station 55+46+/-of said baseline; (6) northeasterly 111+/- feet to a point 196+/- feet distant easterly, measured at right angles, from station 55+69+/- of said baseline; and (7) northeasterly along a curve to the right having a radius of 10.0 feet and an arc distance of 8.7 feet to a point in the south boundary of Williams Street, an existing town highway, 202+/- feet distant easterly, measured at right angles, from station 55+75+/- of said baseline; thence westerly 47+/- feet to a point in the existing easterly highway boundary of Mohawk Golf Club-Aqueduct Pt. 2, S.H. 41-1 being 154+/- feet distant easterly, measured at right angles, from station 55+58+/- of said baseline; thence proceeding southwesterly 272+/- feet along the easterly boundary of said State Highway to a point in the aforementioned 1964 easterly boundary of Mohawk Golf Club-Aqueduct Pt. 2, S.H. 41-1 being 70+/- feet distant southeasterly, measured at right angles, from station 53+59+/- of said baseline; thence southerly 109+/- along the last mentioned 1964 easterly boundary to the point of beginning, being 12,006 square feet or 0.276 acres more or less. The referenced survey baseline is a portion of the 2013 survey baseline for the reconstruction of a portion of the Mohawk Golf Club-Aqueduct Pt. 2, S.H. 41-1, as shown on the map and plan on file in the office of the State Department of Transportation and described as follows: Beginning at Station 47+86.61; thence North 42?32'01"East to Station 54+86.47; thence N 12? 42'52"East to Station 66+99.40.
