NWsource, CITY OF NEWCASTLE NOTICE OF SEPA MITIGATED DETERMINATION OF NON-SIGNIFICANCE Application File: The Atlas Application File Number: SEPA14-001 Applicant: SolTerra Systems, 3220 First Ave S., Suite 800, Seattle WA 98134 City Official Contact: David Lee, Senior Planner Date of Issuance: August 26, 2015 Project Location: 12901 Newcastle Way, Newcastle WA 98059 / Parcel# 282405-9153/9154 Project Description: Construction of a six-story, 98-unit multi-family mixed use building with structured parking and associated site improvements. The project calls for 2,000 square feet of commercial retail space, 61,500 square feet of multi-family residential, three floors of subterranean 65,500-square-foot structured parking. Lead Agency Responsible Official: Tim McHarg, Director of Community Development City of Newcastle Permits: SEPA Determination, Development Agreement, Conditional Use Permit, Type II Site Plan Review and Engineering Review Permit. This determination is based on review of the following information: Project SITE14-001/SEPA14-001: Environmental Checklist, Geotechnical Engineering Study, Traffic Impact Analysis and other information on file with the lead agency. Mitigation Required The Applicant shall provide the following mitigation measures: (1) Due to the large volume of excavation and the period of time the excavation will be left open, a detailed shoring and dewatering plan shall be submitted to the city for review and approval with the Engineering Review Permit. (2) A solid temporary barrier (with a minimum 6 tall height) shall be erected around the excavated area until the city has approved the removal of the barrier. (3)All waters discharged to the citys storm water system as a result of dewatering during construction shall be detained and treated through the use of Baker tanks or similar mechanisms prior to the release of the water into the citys system. (4) If construction activity extends into the right-of-way, a temporary pedestrian plan must be submitted with the Engineering Review Permit and Right Of Way Permit. (5) Applicant shall pay traffic impact fees at the time of building permit issuance. Traffic impact fees do not vest with land use applications and will be assessed the most recent rate in effect at the time of building permit issuance. (6) In regards to Traffic Mitigation, the Applicant shall: (a) Within six months of the project reaching full occupancy, but no longer than one year after issuance of the Certificate of Occupancy, the developer will perform the following tasks for the signalized intersections at Newcastle Way and Coal Creek Parkway SE and Newcastle Way and 129th Avenue SE: (i) Obtain updated AM and PM peak hour traffic turning movement counts. (ii) Perform a traffic analysis using the prevailing signal timings and traffic counts to verify that queues on Newcastle Way do not extend into adjacent intersections. The traffic analysis shall include a summary of traffic conditions in the field, and traffic operations modeling. (iii) If applicable, prepare a modified signal timing plan that prevents queues on Newcastle from extending into adjacent intersections. (iv)If applicable, reimburse the citys cost to implement the modified signal timings. (b) The developer shall financially guarantee the costs associated with the traffic analysis and signal timing adjustment. The financial guarantee shall be included in the performance and maintenance bonds for the project. (c) The costs associated with the signal timing adjustment are not eligible for credit towards Traffic Impact Fees as the signal timing adjustment is not a capital improvement project as identified in the City of Newcastles Comprehensive Plan.( 7) All parking stalls designated for library use shall be clearly designated and signed. Threshold Determination The responsible official of the lead agency finds that the above-described proposal as mitigated does not have a probable adverse impact on the environment. An environmental impact statement (EIS) is not required under RCW 43.21C.030(2)(c). This finding is made pursuant to RCW 43.21C, NMC 14.05 and WAC 197-11 after reviewing a completed environmental checklist and other information on file with the lead agency. The responsible official finds this information reasonably sufficient to evaluate the environmental impact of this proposal. This information is available to the public on request. This MDNS is issued under WAC 197-11-340(2) and does not constitute approval of the permit. This proposal will be reviewed for compliance with all applicable city codes that regulate development activities. Appeals Comments regarding this MDNS may be filed with the city within 14 days from the date of this notice. During this time, the lead agency will not act on this proposal.
