O'Hara, now or formerly of Troy in the state of New York, also now or formerly of Albany in the state of New York, also now or formerly of Delmar in the state of New York also now or formerly of Schenectady in the state of New York or his heirs, devisees, or legal representatives You are hereby notified that an amended complaint has been filed by the above named plaintiff in which you are named as a Defendant. This amended complaint concerns a certain parcel of land in Wellesley, Norfolk County, and said Commonwealth being known as and numbered 40 White Oak Road, plaintiff seeks a judgment that the mortgage from John Kenneth Kearney also known as John K. Kearney to Washington Mutual Bank F.A., said mortgage being dated September 25, 2006 and registered with the Norfolk County Registry District as Document No. 1,112,859 as noted on Certificate of Title No. 162945 is a valid first mortgage on said parcel and that the mortgage from John Kenneth Kearney and Nancy 0. Kearney to Washington Mutual Bank F.A. dated April 13, 2007 and registered with said Registry District as Document No. 1127653 as noted on Certificate of Title No. 162945 is a valid second mortgage on said property, both mortgages now being held by the plaintiff and such other and further relief as the Court deems just and appropriate. This amended complaint may be examined at the Bankruptcy Court, Boston, Massachusetts, or a copy obtained from plaintiff's attorney. If you intend to make any defense, you are hereby required to serve upon the plaintiff s attorney, Jeffrey B. Loeb, Esq, Rich May, P.C., whose address is 176 Federal Street, Boston, MA 02110, an answer to the complaint on or before the July 10, 2015, next, the return day, hereof, and a copy thereof must be filed in this court on or before said day. If you fail to do so, judgment by default will be taken against you for the relief demanded in the complaint. Unless otherwise provided by Rule 13(a), your answer must state as a counterclaim any claim which you may have against the plaintiffs which arise out of the transaction or occurrence that is the subject matter of the plaintiffs' claim or you will thereafter be barred from making such claim in any other action.
