Berkshires Marketplace, NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE Premises: 164 Mill Street, Lee, Massachusetts By virtue and in execution of the Power of Sale contained in a certain mortgage given by Elizabeth T. Connors to MetLife Home Loans, a Division of MetLife Bank, N.A. and now held by Nationstar Mortgage LLC, said mortgage dated October 14, 2008, and recorded in the Berkshire County (Middle District) Registry of Deeds, in Book 4162 at Page 337, as affected by an Assignment of Mortgage dated February 24, 2010, and recorded with said Deeds in Book 4506 at Page 147, as further affected by an Assignment of Mortgage dated March 27, 2014, and recorded with said Deeds in Book 5360 at Page 106, of which mortgage the undersigned is the present holder, for breach of the conditions in said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on July 7, 2015, at 11:00 AM Local Time upon the premises, all and singular the premises described in said mortgage, to wit: PARCEL ONE: Commencing at a post in the East line of Mill Street, co-called, and southerly of Sunshine Avenue, co-called, a right of way in said Lee; thence Easterly along the Southerly line of said right-of-way one hundred and thirty-three feet, more or less, to land formerly of Ida M. Houghtaling; thence Southerly along the line of the land formerly of Ida M. Houghtaling one hundred feet; thence westerly and parallel with the first mentioned bounds one hundred and thirty-three feet, more or less, to said highway called Mill Street, thence northerly on the East line of said Mill Street one hundred feet to the place of beginning. The above described premises is the westerly part of the premises conveyed by Elsie O. Wagner to Eugene Cuene and Cecelia Cuene, by deed dated December 4, 1900, and recorded in Berkshire Middle District Registry of Deeds, Book 311, Page 219. PARCEL TWO: Commencing in the East line of said highway at the Northwest corner of the premises to be conveyed and the Southwest corner of Parcel 1; thence easterly in a straight line two hundred and thirty-three feet, more or less, to land of one Mouhat; thence southerly in the west line of said Mouhat one hundred feet to the northerly line of land formerly of the Lee Canning Company; thence westerly and parallel with the first mentioned bound two hundred and thirty-three feet, more or less, to said highway; thence northerly on the east line of said highway one hundred feet to the place of beginning. The description of the property contained in the mortgage shall control in the event of a typographical error in this publication. For Mortgagor's Title, see Deed dated October 31, 1985, and recorded in Book 1131 at Page 391 with the Berkshire County (Middle District) Registry of Deeds. TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described. TEN THOUSAND ($10,000.00) Dollars of the purchase price must be paid in cash, certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser.
