Delco News Network, PUBLIC NOTICE NOTICE IS HEREBY GIVEN that Chadds Ford Investors, L.P. is providing optional public notice pursuant to Section 108 of the Pennsylvania Municipalities Planning Code (the “MPC”), 53 P.S. §§ 10108, of municipal action in Concord Township, Delaware County. This notice is intended to provide an opportunity to challenge, in accordance with Section 1002-A(b) of the MPC, 53 P.S. §11002-A(b), the validity of the Zoning Ordinance No. 366, enacted on July 21, 2015 (the “Ordinance”), on the basis that a defect in procedure resulted in a deprivation of constitutional rights, and to establish a time period of limitations for raising such challenge. The Ordinance amended Section 210-160.1(B)(1)(a) of the Zoning Ordinance, regarding permitted uses within the Loop Road Overlay District, by adding subsection [12] to include health centers, medical offices, rehabilitation and therapy centers, sports medicine facilities and urgent care facilities, provided such uses do not include overnight stays. Any person claiming a right to challenge the Ordinance must bring legal action within 30 days of the publication of the second notice. Publication of notice is required once each week for two successive weeks. This is the first publication of this public notice. The full text of the Ordinance may be examined by members of the public at the Concord Township Municipal Building located at 43 S.
