Main Line Times, NOTICE OF PRELIMINARY OPINION Notice is hereby given by the Zoning Officer of Narberth Borough of his Preliminary Opinion pursuant to Section 916.2 of the Pennsylvania Municipalities Planning Code (“MPC”), 53 P.S. § 10916.2, in connection with property located at 724 and 732 Montgomery Avenue, Narberth, Narberth Borough, Montgomery County, and further identified as Tax Parcel No. 12-00-03766-00-2 (collectively, “Property”), which is owned by Royal Real Estate of Pennsylvania Inc. (“Owner”). The Property is located in the C-Commercial Zoning District of the Borough of Narberth and the rear of the Property is located in the R-4 Residential Zoning District. The Property is currently improved with two (2) buildings used for bank/office purposes and a parking lot with 55 striped parking spaces. All of the existing improvements are located in the C-Commercial Zoning District. The Owner has received approval to subdivide the Property into two lots as shown on the Preliminary/Final Plan of Mortgage/Financial Subdivision prepared by Howell Kline Surveying, LLC dated June 12, 2015 (“Plan”), which was approved by Narberth Borough Council on July 13, 2015. The two lots will share all of the existing parking spaces, which will be memorialized by way of a recorded Reciprocal Easement and Restrictions Agreement. The Zoning Officer’s Preliminary Opinion is as follows: 1. The Property is currently legally nonconforming with respect to the number of required parking spaces for both office/bank use and retail use as set forth in § 124-55.2.B. of the Narberth Borough Zoning Ordinance with the existing parking on the Property totaling 55 striped parking spaces (“Non-conforming Parking Spaces”); 2. The existing parking lot on the Property may be restriped to include a total of 63 parking spaces; 3. Retail is a permitted use in the C-Commercial District, and therefore the Owner may convert any floor(s) of the existing buildings from office/bank use to retail use; 4. Neither the conversion of any floor(s) of the existing buildings from office/bank use to retail use nor the subdivision of the Property will result in the need to add additional parking over the Non-conforming Parking Spaces. Any aggrieved party wishing to commence a proceeding with the Zoning Hearing Board pursuant to Section 914.1 of the MPC, 53 P.S. § 10914.1, must do so within the time set forth in § 914.1, which is 30 days from the date of the second publication of this Notice of Preliminary Opinion. Information describing the proposed use is available for public inspection, free of charge, or may be purchased for the cost of copying during regular business hours at the Narberth Borough Building, 100 Conway Avenue, Narberth, Pennsylvania.
